Patent LitigationSpring 2010 Instructor: Justin Beck Introduces the unique procedural and substantive aspects of patent litigation, including prefiling and pleading requirements, declaratory relief, claim interpretation, invalidity defenses, and attorney-client privilege issues. Students follow a hypothetical patent case from initial client contact through trial, and have the opportunity to prepare pleadings, develop infringement and invalidity positions, and argue claim construction in a simulated Markman hearing. Prerequisite: Civil Procedure. A prior course in patent law is recommended but not required. |
